These Terms & Conditions (“Terms”) govern your use of the Performance Auto Collision website and the online inquiry and estimate tools it provides. Please read them carefully. By accessing the site or submitting a form you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the site.

01About this website

This website is operated by Performance Auto Collision, a collision repair and refinishing shop located at 5418 Paschall Ave, Philadelphia, PA 19143. The site provides information about our services, lets you contact us, and lets you request a preliminary repair estimate. It does not sell products, process payments, or create customer accounts.

Information on this site, including service descriptions, timelines, gallery photos, and customer reviews, is provided for general information and may change without notice. Repair results vary by vehicle and damage.

02Online estimate requests

Submitting the estimate form is a request for information, not a repair order. Any figure we provide based on your form, photos, or a phone conversation is a preliminary estimate only. It is not binding and is not a commitment to repair your vehicle at that price.

A final written estimate is prepared after we inspect the vehicle in person. Collision damage is often hidden behind panels and can only be identified during teardown. If additional damage is found, we will stop, explain the findings, and obtain your approval (and, where applicable, your insurer’s approval) before performing additional work.

All repair work is governed by the written repair authorization and invoice you sign at the shop, as required by Pennsylvania’s Automotive Industry Trade Practices regulations. If these Terms and your signed repair authorization conflict, the repair authorization controls for that repair.

We respond to estimate requests during business hours (Monday to Friday, 8:00 AM to 6:00 PM, and Saturday, 9:00 AM to 2:00 PM). Submitting a form does not reserve an appointment or a place in our repair schedule.

03Insurance claim assistance

We work with all major insurance carriers and will help you navigate your claim, communicate with adjusters, and document the damage. This assistance is a courtesy. Your insurance carrier, not Performance Auto Collision, decides what your policy covers, which parts it will pay for, and whether a rental is provided.

You remain responsible for your deductible, for any charges your insurer declines to cover, and for the cost of any upgrades or additional work you authorize. Under Pennsylvania law you have the right to choose the repair shop that fixes your vehicle; you are never required to use a shop suggested by your insurer.

04Lifetime Craftsmanship Guarantee

We stand behind our workmanship. Our Lifetime Craftsmanship Guarantee covers defects in the repair and refinishing work we perform, such as paint peeling, bubbling, or fading, and body panel misalignment caused by our work, for as long as you own the vehicle. The full written guarantee, including the claims process and exclusions, is provided with your repair invoice and controls over this summary.

The guarantee does not cover parts (which carry their own manufacturer warranty), normal wear, stone chips, damage from new collisions or environmental causes, rust or corrosion originating from areas we did not repair, damage caused by neglect, misuse, or improper care, or work performed by anyone else after our repair. The guarantee applies to the original vehicle owner and is not transferable unless stated otherwise in your written guarantee.

05Your responsibilities

When you use this site or submit a form, you agree that you will:

  • Provide accurate, current, and complete information, including a phone number and email address where we can reach you.
  • Only submit inquiries about vehicles you own or are authorized to have repaired.
  • Not submit forms using automated tools, bots, or scripts, and not submit repeated or bulk inquiries.
  • Not upload or transmit anything unlawful, defamatory, infringing, or harmful, including malware or code intended to interfere with the site.
  • Not attempt to probe, scan, or test the vulnerability of the site, bypass its spam protections or rate limits, or access any part of it you are not authorized to use.
  • Not scrape, copy, or republish the site’s content or images except as allowed under Intellectual Property below.

We may block, rate-limit, or ignore submissions that violate these rules and may report unlawful activity to the appropriate authorities.

06Communications and consent

By submitting a form you consent to Performance Auto Collision contacting you about your inquiry by the method you selected. If you select text, you agree to receive text messages as described in our Privacy Policy and may opt out at any time by replying STOP. Our communications are limited to your inquiry, estimate, and repair unless you separately agree to receive other messages.

07Intellectual property

The Performance Auto Collision name, logo, emblem, and the design, text, graphics, photographs, and other content on this site are owned by Performance Auto Collision or used with permission and are protected by copyright, trademark, and other laws. You may view, print, or save pages for your personal, non-commercial use in connection with our services. Any other reproduction, distribution, modification, or commercial use without our prior written consent is prohibited.

Photographs of customer vehicles shown in our gallery and reviews are published with the owner’s permission or with identifying details removed. If you would like a photo of your vehicle removed, contact us and we will take it down.

09Website disclaimer

The website is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties about the website itself, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, or free of harmful components, or that a form submission will always be delivered.

If your inquiry is urgent and you have not heard back from us within one business day, please call 610-808-7442 so we can be sure we received it.

This disclaimer applies to the website only. It does not limit the Lifetime Craftsmanship Guarantee, the terms of your signed repair authorization, or any warranty or consumer right that Pennsylvania law does not allow us to disclaim.

10Limitation of liability

To the fullest extent permitted by law, Performance Auto Collision and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of, or inability to use, the website or the information on it, including lost data, lost business, or the cost of substitute services, even if we were advised such damages were possible.

This section limits liability arising from the website only. Liability for repair services we actually perform is governed by your signed repair authorization, our written guarantee, and applicable Pennsylvania law, and nothing in these Terms limits liability that cannot be limited under that law, including for gross negligence, willful misconduct, or personal injury.

11Indemnification

You agree to indemnify and hold harmless Performance Auto Collision and its owners, employees, and agents from any claims, losses, or expenses, including reasonable attorneys’ fees, arising from your misuse of the website, your violation of these Terms, or false or misleading information you submit through the site.

12Governing law and disputes

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-law rules. Any dispute arising from the website or these Terms will be brought in the state or federal courts located in Philadelphia County, Pennsylvania, and you consent to the jurisdiction of those courts. Before filing a claim, we ask that you contact us so we can try to resolve the issue directly.

Nothing in this section prevents you from filing a complaint with the Pennsylvania Office of Attorney General, Bureau of Consumer Protection, or from pursuing any remedy available to you under Pennsylvania consumer protection law.

13General terms

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the website. They do not replace or modify any written agreement for repair services.

14Changes to these Terms

We may revise these Terms from time to time. Changes take effect when posted on this page with an updated effective date. Your continued use of the website after a change means you accept the revised Terms.
